On March 21, 2019, Judge Stephen Kaus of the Alameda County Superior Court granted final approval of a $390,000 class action settlement in Juarez v. Oakland Pallet Co., Inc. for two classes of workers: those who worked on a piece rate basis, and those employed as truck drivers. The settlement resolved three cases that had been consolidated in 2017. In these cases, Plaintiffs alleged that their employer, Oakland Pallet Co., Inc., failed to properly compensate piece rate workers for “nonproductive time” and rest periods, failed to pay truck drivers for all hours worked due to a practice of rounding their time entries, and failed to compensate drivers for business expenses, among other claims under the California Labor Code, the Industrial Welfare Commission Wage Orders, and the Private Attorneys General Act.
