Motion for Preliminary Approval of Settlement Filed in Castro v. ABM Industries, Inc.

Plaintiffs Marley Castro and Lucia Marmolejo have filed for preliminary approval of a $5.4 million class action settlement in Castro v. ABM Industries, Inc. Plaintiffs allege that their employer, ABM, failed to reimburse them and other janitorial employees throughout California for work-related use of their personal cell phones, in violation of California Labor Code § 2802, the California Unfair Competition Law, and the Private Attorneys General Act (PAGA). In January of 2018, Judge Yvonne Gonzalez Rogers of the United States District Court for the Northern District of California granted class certification. The hearing on the motion for preliminary approval is scheduled for February 12, 2019.
