Numerous Arbitrators Rule in Favor of Misclassified Amazon Flex Delivery Drivers

Fifth Circuit Affirms Class Certification in Chavez v. Plan Benefit Services, Inc.
On July 15, 2024, the Fifth Circuit Court of Appeals affirmed the Western District of Texas’s certification of a class of more than 290,000 participants in more than 3,000 plans that provide employee benefits through the Contractors and Employees Retirement Trust (CERT) and the Contractors Plan Trust (CPT). Defendants Fringe Benefit Group (FBG) and Fringe Insurance Benefits, Inc. (FIBI) operate these two trusts and provide administrative and marketing services to plans that participate in the trusts. Plaintiffs allege that Defendants have violated ERISA by controlling disbursements from the trusts (including payment of their own excessive fees), using this control to collect fees that were not explicitly agreed to by employer and were never disclosed to plan participants, and selecting service providers for the plans that maximized Defendants’ compensation at the expense of participants.

FJWW Welcomes New Workplace Justice Fellow, Noa Batlan
Noa is a recent graduate of UC Davis School of Law, where they directed the Gender and Name Change Clinic and advocated on behalf of clients in removal proceedings through the Immigration Law Clinic. During law school, Noa also volunteered to support undocumented, low-wage workers in applying for the Deferred Action for Labor Enforcement program. Their research on the criminalization of gender affirming healthcare was published in the Texas Journal on Civil Liberties and Civil Rights.

Ciara O’Neill joins FJWW as a Summer Law Clerk. Ciara is a rising 2L at Berkeley Law, where she is a Senior Executive Editor of the Berkeley Journal of Employment and Labor Law, Events Chair for the Plaintiffs’ Law Association, and Co-leader of the Drug Policy, Education, and Decriminalization Project.
Before law school, Ciara worked as an ERISA paralegal at a plaintiff-side firm and as a policy specialist for the Colorado Department of Health Care Policy and Financing. Ciara graduated with a B.A. in Government and Classics from Georgetown University.
